Terms, Contract and Liability Information - US CAR MOVE, LLC. 2018

1. Carrier will pick up and deliver your vehicle as close to your door as possible (only if legal and safe). A mutually agreed place to load and unload may be necessary because of narrow streets, trees and possible residential area restrictions. (Only applicable for ground transportation).

2. US CAR MOVE, LLC. will provide Customer with estimated pick up and delivery dates. However, there are no guarantees about the pick up or delivery times and dates. Delays could happen prior to, and/or during transport due to road or sea conditions, weather and mechanical problems. US CAR MOVE, LLC. is not to be held responsible for damages or loss caused by any type of problem or any other reason, car rental fees or lodging fees. US CAR MOVE, LLC. is not to be held liable for failure of mechanical or operating parts of your vehicle.

3.US CAR MOVE, LLC. and the Carrier contracted are authorized to operate and transport your motor vehicle between the agreed places established in the B.O.L – bill of lading.

4. The vehicle must be prepared for transportation by you (the Customer). Any low hanging spoilers, accessories and loose parts must be removed and/or safely secured to the vehicle. You (the Customer) must remove all external not permanent mounted racks and other elements prior to shipment. Vehicles must be presented to the Carrier in good running condition (unless no-running/operable noted in the order) with no more than half a tank of fuel. The part of the vehicle that falls off (separates) while the vehicle is in transit is the Customer responsibility, including damages caused to your vehicle or to other vehicles and/or person involved during transportation.

5. The Customer must deactivate any vehicle alarm systems installed or provide the necessary instructions to the Carrier to disconnect it. If any alarm goes on and there are no keys or instructions to turn it off, the Carrier may silent alarm by any means. If the battery of the vehicle goes dead for that reason, it will not be the responsibility of the Carrier or US CAR MOVE, LLC.

6. Luggage and personal property must be collected in one suitcase or bag only in trunk. NO heavy articles are allowed, not to exceed 100 lbs (Only applicable only ground transportation. Personal property is not allowed on sea freight) . The Carrier and US CAR MOVE, LLC. are not liable for any personal items left in the vehicle, nor for any damage caused to the vehicle from unreasonable or improper loading of personal items. Personal property shall not be transported in customer vehicle(s), that includes but is not limited to alcoholic beverages, jewelry, furs, money, live pets, live plants, explosives, guns, ammunition, flammable products, narcotics, negotiable and legal papers, or any unlawful contraband. The Customer agrees that CUS CAR MOVE, LLC. may confiscate or dispose of mentioned items with no reimbursement. US CAR MOVE, LLC. is not to be held responsible for the loss of personal property.

7. If the vehicle is inoperable or over-sized (dual or oversize wheels, extra-large, racks, lifted, limo), the Customer must inquire as to extra charges. If US CAR MOVE, LLC. is not advised of inoperable or over-sized and/or modified vehicles prior to pick-up, or the load in the vehicle exceeds 100 lbs, all extra charges must be paid according to the agreement, either in cash or with money order upon delivery.

8. For international orders, the vehicle must be empty except for factory installed equipment. The Customer must indicate serial #, and gives the vehicles approximate value in U.S. Dollars.

9. US CAR MOVE, LLC. has the right to reject and/or cancel any order for any reason at any time.

10. At pick up, Customer and Carrier will fully inspect the vehicle for pre-existing damages – exterior only – and complete vehicle inspection report (B.O.L). Carrier and Customer will both agree to the condition of the vehicle and the Customer will sign and receive a copy of the bill of lading and the report. At delivery, Customer and Carrier will carefully inspect the vehicle for outside damages due to transportation. Carrier and Customer will both confirm the condition of the vehicle and the Customer will sign and receive a final copy of the bill of lading and the report.

11. The Carrier takes responsibility of the vehicle(s) after the pre-inspection is done and signed by the Customer. The Carriers responsibility ends when the vehicle(s) is delivered and the Customer has signed the final inspection report. Damages must be written down in the designated place on the bill of lading and signed by the Customer, regardless of weather conditions, the time of the day and the dirt of the vehicle. When the Customer signs the bill of lading and the inspection report without noting any damage, this confirms/means that the Customer has received the vehicle(s) in satisfactory condition, and that US CAR MOVE, LLC., the Carrier and their agents are relieved of any further responsibility.

12. US CAR MOVE, LLC. will not be responsible for any damage caused by the acts of God, such as hail, storm or snow damage, or damages resulting from worn and/or broken parts of the vehicle or any items stored inside the vehicle.

13. Should you need to file a damage claim, it must be submitted in writing and signed on the B.O.L within 24 hours of delivery. US CAR MOVE, LLC. will share the Carriers insurance policy upon your (the Customer) request. As outlined in Section 10761 of the Interstate Commerce Act (49 USC 10761), the payment of freight charges shall not be postponed due to alleged loss or damage. The Customer must pay these charges in full and the portion applicable to the lost or damaged item must be included in the freight claim. The following items are important to remember: a) Claims and payment of freight charges are two completely different and separate transactions. b) ICC regulations prohibit withholding payment of freight bills because of a pending claim (Administrative Ruling No. 128). c) Without payment for the freight charges, payment for transportation has not been made. Until freight charges are made, a valid claim will not be paid.

14.If the Customer will be absent at pick up or delivery, he should designate a person to act on his behalf and release or accept the vehicle.

15. The Customer will pay the auto transport price of his order due to US CAR MOVE, LLC. in full and will not try to compensate any dispute for damage claims and/or delays from freight charges. The Customer is responsible to prepare any payment due to the Carrier upon delivery - Cash, Cashier´s check or Money Order - no exceptions are allowed. If you must use certified funds, they should be made payable to the Carrier and not to US CAR MOVE, LLC. Personal checks and debit or credit cards will not be accepted for the remaining balance – no exceptions are allowed. The Customer agrees that if the payment cannot be made by any of these methods, the vehicle/item will be stored at the Customers expense until the Customer pays in full for all shipping charges. If the Customer can not receive the delivery of the vehicle(s) for any reason, the vehicle(s) will be placed in storage. Any and all storage and re-delivery charges will be the Customers responsibility.

16. This agreement shall be construed in accordance with the laws of the State of Florida. Any legal venue arising from this contract will take place in Broward County, Florida. The Customer agrees to pay all legal fees associated with contract. This choice of venue is intended by the parties to be mandatory and to prevent the possibility of litigation between the parties with respect to, or arising out of, this agreement in any jurisdiction other than the specified in this section. Each party waives any right it may have to object to venue with respect to any arrangements brought in accordance with this section. This agreement and all shipment(s) are subject to the Carriers tariff and the uniform bill of lading, and all terms and conditions of the Carrier which can be found at the office of the carrier. All previous oral and written representation of US CAR MOVE, LLC. is overwritten herein by the current agreement. The current agreement is final and shall not be changed except in writing and signed by an agent of US CAR MOVE, LLC.

17. Car Freight will not be responsible for any additional charges by any Port of the United States and Puerto Rico, this includes: "Demurrage charges" or storage charges, "VACIS Exam" (gamma rays), "USDA Treatment", removal of gasoline or personal items in the vehicle, among others.

18. t is compulsory that every vehicle that is transported from the United States to Puerto Rico and vice versa must contain ¼ gasoline to be accepted at any Port.

19. Due to different factors such as: the cost of gasoline, climatic conditions, error in the measurements of the unit and / or weight, among others, both the Overseas and Inland fares can change (increase) without prior notice. For this reason, the Client is responsible for paying the outstanding balance before receiving or picking up unit, as applicable.

Cancellations and Refunds

Your order cancellation must be done in writing via an email sent to servicios@uscarmove.com . Once an order has been dispatched/assigned to a Carrier or a shipping company, you will be notified by phone.
If you want to cancel the order once it has been assigned to a Carrier (for door-to-door transportation within the States), US CAR MOVE, LLC. will deduct a 15% of the payment made for that booking. If the payment of the booking is less than $100.00 (one hundred dollars), the Customer authorizes US CAR MOVE, LLC. to make an extra charge to complete the remaining amount up to $ 100.00 (one hundred dollars). Once your vehicle has been picked up by our Carrier, there won´t be any type of cancellation.
If the Customer is sending his vehicle from Puerto Rico to US or from US to Puerto rico and he decides to cancel that booking, US CAR MOVE, LLC. will apply a charge of 15% for administrative expenses, which will be deducted from the previous payment made to US CAR MOVE, LLC.. The Customer will be reimbursed afterward for any remaining balance in full. Once your car has been picked up by our carrier, will not proceed any cancellation.
If the client is sending your vehicle from Puerto Rico to the United States or from United States to Puerto Rico and decides to cancel the reservation, US CAR MOVE, LLC.. will apply a charge of 15% for administrative expenses, which will be deducted from payments previously paid to US CAR MOVE, LLC.. Later any remaining balance will be refunded in full. The value of the marine insurance will not be refundable, either partial or total once it has been contracted by the client and processed by US CAR MOVE, LLC.

Preparar su Carro para el Transporte

Cuanto mejor prepare su carro, nosotros mejor le serviremos.

Al momento de preparar su carro para el transporte lo primero es verificar que no tenga fugas de líquidos. Deberá revisar bajo el carro y el capó. Si hubiese una fuga, tendrá que repararla antes de entregar el auto para el transporte, pues podría dañarse aún más durante el transporte o dañar los otros carros que van en el tráiler.

A continuación deberá revisar el estado de la batería de su carro. La batería no puede estar rota o trizada, asimismo debe estar muy bien sujeta porque el movimiento del transporte pudiese afectarla.
También, y sumamente importante, los niveles de líquido de la batería deben estar medios, nunca llenos, para dejar espacio a la expansión que se produce por la altura o el calor.
